Conditions of Use

  1. This document (the “Report”) is being sold to the person or organisation completing it’s purchase (hereafter the “Licensee”) for use by an individual or to an individual working within an organisation (hereafter the “Primary User”) for that Primary User’s individual and singular use. The Licensee accepts responsibility for meeting the Terms and Conditions expressed here, even though the Primary User of the Report may be someone other than the Licensee.
  2. Insight SRI LLC.  ("Insight SRI", or “ISRI”) is the publisher and legal owner of the copyright subsisting in this Report. Any use and/or copying of such documents and materials which is not in accordance with these Conditions of Use is unauthorised. Any unauthorised use may give rise to Insight SRI bringing proceedings for both License Violation and Copyright Infringement against the Licensee claiming an injunction, damages, and costs.
  3. A single copy of the Report may not be jointly used by a group, a library, school, board, conference, assembly, ‘working group’, or other body where the intent or application is for multiple readers to use or refer to a single hard or electronic copy  of the Report except where the individual readers each acquire a copy for their own individual use, and  except as described in item 5, below.
  4. The Licensee is responsible for maintaining control over this document, and ensuring that it is not copied or distributed to parties other than the Primary User. The Licensee further undertakes to ensure that the Primary User shows or shares the Report on a temporary basis with no more than one additional person within their own organisation.
  5. If this Report is to be read by more than one person, permanently transferred to a person other than the original Primary User, or is to be kept or used on a detailed basis by any persons other than the Primary User then additional copies must be purchased by these additional persons for their own individual use. The Licensee undertakes to ensure that these terms are met. Use “on a detailed basis” is deemed to be any use involving reading any section of the report in detail, any reading that leads to subsequent use of Report material, or any reference to the Report including quoting, citing, or any use of Report content including use of any images, data, figures, tables, illustrations, text, or other content in any paper, document, verbal or written presentation, or any other product for private or public use.
  6. The Licensee acknowledges that unless otherwise stated, all information and materials contained in this report are the copyrighted property and confidential information of Insight SRI, and are protected, inter alia, by the national copyright laws of the US, Europe, and other countries including but not limited to the Copyright Act of 1976 (USA), the Copyright, Designs and Patents Act 1988 (UK) and other intellectual property rights and by these Terms and Conditions. The Licensee acknowledges that no rights in any of the materials are transferred to the Licensee or Primary User. The Licensee undertakes that it will not allow any persons to copy, reproduce, print or store in any manner (electronic or otherwise), extract or transmit in any form or otherwise deal with in any way the whole or part of the data, materials or information contained in this report other than as delivered to the Licensee by Insight SRI for the Licensee’s individual use.
  7. Unless agreed in writing in advance by insight SRI, this document may not be sold, passed on, communicated or disseminated in any form (including within its original covers), nor access granted, to any third party or to any subsidiary, associated or holding company (whether direct or indirect) of the original subscriber/licensee/purchaser and its user(s) (together, the "Licensee") except as permitted by items 4 and 5 above, the US Copyright Act of 1976 (amended October 2009) as 17 U.S.C. § 107 (United States), and other international standards of “fair use”.
  8. Excepting brief quotations of text and figures to be embodied in articles and reviews, copying or use in whole or in part of this in any public or private publication or application, including use of charts, pictures or graphics constitutes a beach of these Conditions of Use and a violation of the terms of purchase. Such action entitles Insight SRI to bill the Licensee for the actual or inferred number of additional copies used, shared, or distributed.
  9. The Report may not be distributed electronically by the Licensee nor posted in whole or in part on any website, intranet, forum, or other site. Which prohibition extends to the use of any and all charts, graphics, images, figures, tables, or other content. Any such person doing so (hereafter, the Distributor) accepts legal and financial liability for the distribution of such content. The Distributor and Licensee acknowledge that they are responsible for each instance of this Report being viewed or downloaded from a website. Each individual page impressions, viewed extract from this Report, or any other such viewing constitutes a separate purchase of the full report by an additional user. The Distributor and Licensee agree that Insight SRI is entitled to bill the Licensee and Distributor jointly or severally in the full price of the Report for each instance of page impression or downloaded copy. The Licensee and Distributor agree to pass over all records relating to the number of instances. If such records are not available or if such data is not tracked or stored by either the Licensee or Distributor, Insight SRI reserves the right to assign an estimated number of downloads and to charge the Licensee and or Distributor for the estimated number.
  10. The Licensee (or any subsequent user, whether licensed or unlicensed who reads this report) agrees it will not place financial reliance upon any figure, statement or inference contained within this or any other Insight SRI report, or invite investment from others, without first obtaining the written consent of Insight SRI so to do. In the event that the Licensee (or any subsequent user, whether licensed or unlicensed) does not follow this procedure, it (or any subsequent user) agrees fully and effectually to indemnify Insight SRI against any claims, howsoever arising, and to draw specific attention to the fact that this consent has not been obtained.
